DMCA Copyright Infringement

If your copyright has been infringed please provide the following information in writing as set forth in 17 USCS 512 (c)(3).

i   A physical or electronic signature of a person authorized to act on behalf of the owner of  an exclusive right that is allegedly infringed.

ii   Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

iii   Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.

iv   Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

v    A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.

vi    A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Should a counter notice be received by the copyright agent, bodyarchives.com may email a copy of the counter notice to the original party claiming infringement.

Upon written resolution of the conflict between the parties and upon presentation of that written resolution to bodyarchives.com the submission may be reposted.

Counter Notification  

If you believe that your submission is not infringing, you may send a written counter notification containing the following elements to the copyright agent:    (A) A physical or electronic signature of the subscriber.   (B) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.   (C)A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.   (D) The subscribers name address and telephone number and a statement that the subscriber consents to the jurisdiction of Federal District Court in Suffolk County, New York, USA and that the subscriber will accept service of process from the person who provided notification under subsection c 1 C or an agent of such person.

Where may members post images?

Members may post images in the Body Gallery (Modeling Photography) and Art Gallery (Art).

What is the difference between the Body Gallery and Body Archives?

The Body Gallery is an area where a member can post modeling (nude or clothed) photographs.  The Body Archives material is posted by the website administrator and is an area where contemporary and vintage images and content of clothed subjects is placed. 

How many times can my image be viewed by the same user and have it counted as Views that appears under my image?

An image is counted as having been viewed one time per day per user.

Are images in the Body Archives and Nude Archives counted in the Most Viewed Females and Most Viewed Males?

No.  Although images in the Body Archives and Nude Archives will indicate the number of views, only images posted by members in the Body Gallery and Art Gallery are counted in the Most Viewed categories.  In some instances images may appear in the Body Gallery or Art Gallery and either of the Archives, but it is only those images posted by members in the galleries that are counted among the Most Viewed.  The Main Photo is not counted among the Most Viewed unless it is posted additionally to either the Body Gallery or Art Gallery.

What is the Art Gallery?

The Art Gallery is comprised of different categories and is where a member can post Art that is of the members’ own work as the artist/photographer or model.  Collectors may post art that is from their collection providing it is public domain or the collector has permission of the copyright owner that it may be posted.  

Can I post contemporary photos, film or video images of nudes?

Yes, providing the person in the photograph is over 18 years of age and the work is professional in quality.  You are responsible for a model release documenting age and identity of the model for any photographs, video, film images or images from other electronic media.

What does public domain mean?

Public domain is defined as not being protected by copyright so that the content is available for public use.

Can I post an image of my drawing of a nude?

Yes, you may post it in the Art Gallery.  Images of nudes in any medium may be posted in the Art Gallery.

What is the Nude Archives?

The Nude Archives is content relating to nudes posted by the website.  There is documentation of the age and identification of the contemporary model.

What are good settings for me to upload images?
Re-size image to 72 PPI, 800 pixels at widest dimension. Save for Web, RGB, JPEG, check Constrain Proportions, Quality 60  

How can I find a member on bodyarchives.com?

Hit the Advanced Search button on the far right of the Homepage near the top.  When the Find a Friend window appears check off Username and type in the Username of the person you want to locate.  Hit Enter and it will bring up the Profile contact for that person.

What is the Search box at the top of the Homepage for?

The Search box at the top of the Homepage will locate images that have had keywords entered for those images.  It will also locate the Username of a member when that member has posted images in either or both the Body Gallery and Art Gallery as well as images of, or related to that member that appear in the Archives.
